Usage Policy.
This Usage Policy applies to every person, business and partner using Mellovy’s AI services, including hosted services, partner-served deployments, customer-infrastructure deployments, agents, integrations and connectors. It covers prompts, files, connected data, outputs, instructions and actions carried out through a Mellovy service. It supplements the terms that govern your account or deployment.
Use Mellovy lawfully and in a way that respects the safety, privacy and rights of other people. You are responsible for the instructions you give an agent, the permissions you grant, the data you connect and the actions you ask it to perform.
1. Prohibited uses
You must not use Mellovy, or allow another person to use it, to:
- Break the law, facilitate serious wrongdoing, infringe intellectual property or privacy rights, or evade a legal restriction.
- Create, solicit, distribute or facilitate child sexual abuse material, sexual exploitation of a child, or sexual content involving a child.
- Create or distribute non-consensual intimate imagery, or use a person’s voice, image or identity to deceive, harass, threaten or exploit them.
- Threaten or encourage violence, terrorism, abuse, self-harm or suicide, or provide operational assistance intended to cause serious physical harm.
- Defraud, phish, impersonate, spam, extort or deceive people, or use agents to send unsolicited or abusive communications.
- Target a person or group for harassment or unlawful discrimination, or exploit a person’s vulnerability to cause harm.
- Access, collect, alter, delete or disclose information or systems without permission, or use a connection to act outside the authority granted by its account holder.
- Create or deploy malware, steal credentials, exploit security weaknesses, interfere with infrastructure, or bypass access controls, safety protections, rate limits or monitoring.
- Use outputs or other service materials to develop or train a competing general-purpose AI model, except where Mellovy has agreed otherwise in writing or applicable law does not allow this restriction.
2. Practices prohibited by the EU AI Act
Where Regulation (EU) 2024/1689 (the EU Artificial Intelligence Act) applies, you must not use Mellovy to carry out an AI practice prohibited by Article 5 of that Regulation. These prohibited practices include, where the legal conditions are met, harmful manipulation or deception, exploiting a person’s vulnerability because of age, disability or a specific social or economic situation, certain social scoring, certain forms of biometric categorisation, and untargeted scraping of facial images to create or expand facial recognition databases. The prohibition applies according to the facts and legal exceptions; this summary does not broaden or narrow the Regulation.
Do not configure or use Mellovy for a high-risk purpose under the EU AI Act, including certain uses in employment, education, access to essential services, creditworthiness, insurance, law enforcement or migration, unless the purpose has been expressly enabled under a business agreement and all applicable legal requirements have been assessed and met. A contract with Mellovy does not by itself make a high-risk use lawful.
3. Human review and agent permissions
Do not use an AI system to make a decision with legal or similarly significant effects about a person without the human oversight, safeguards and rights required by law. Where you use an agent to send communications, modify records, make purchases or take another consequential action, grant only the permissions needed, monitor its activity and maintain a way to stop or revoke the action where the integration allows it. You remain responsible for actions you authorise, subject to the responsibilities imposed on Mellovy by law and the applicable agreement.
4. AI transparency and generated content
The Mellovy chat interface identifies when a person is interacting with AI. Mellovy and customers must each provide the notices or markings required by law for their role and use of the Service. Do not remove, disable or conceal a disclosure or mark provided by Mellovy or required by law. Do not represent AI-generated content as human-created where applicable law requires disclosure.
5. Personal data and confidential information
Do not submit personal data, confidential information or sensitive information unless you have authority and a lawful basis to do so, and the Mellovy feature you are using is designed to process it. Follow the Privacy Policy and, for business deployments, the applicable data processing agreement. Do not use connected account information for a purpose the account holder has not authorised.
6. Safety, security and access
You must not probe, scan, overload or test the security of a Mellovy service without prior written authorisation. Do not circumvent safeguards, disguise the source of abusive activity, scrape service content outside supported interfaces, share credentials, or attempt to gain access to another user’s data. 7. Enforcement and reporting
Mellovy may review activity to investigate a credible report, protect people or systems, prevent fraud or abuse, or comply with law. Depending on the circumstances, Mellovy may remove or restrict content or actions, limit features, suspend access or terminate an account. We will take account of the nature, seriousness and recurrence of the conduct, the risk posed and any explanation provided. Where lawful and practicable, we will explain a restriction and give you a way to challenge it. Nothing in this section removes rights available under applicable law.
Report a suspected violation to [email protected] or [email protected]. If law requires a report to a competent authority, Mellovy may make that report.
8. Changes to this policy
We may update this policy to reflect changes in the Service, safety risks or applicable law. We will notify users of material changes through the Legal Center or another appropriate channel. Your mandatory legal rights are not reduced by a policy update.
